Terms of Sale and Licence — KomMeter for Desktop

These terms govern the purchase and use of KomMeter for Desktop — the Linux and Windows version of KomMeter, a tracker for utility meters, tariffs and payments ("the App"). KomMeter for Desktop is developed and sold by Oleksandr Fedorko, an individual software developer based in Ukraine, trading as Foleks Apps Studio ("we", "us", "our"). You can reach us at apps@foleks.com.

The KomMeter app for Android phones is free and is not covered by these terms.

1. Our Reseller

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is also subject to the Paddle Buyer Terms.

2. What You Buy

You buy a licence to use the App, not the App itself. Two options are offered on the pricing page:

  • Lifetime — a single payment; the licence does not expire.
  • Yearly — a subscription that renews automatically every year until you cancel it.

Prices are shown in your local currency where possible. Taxes are calculated at checkout by Paddle according to your location.

3. Free Trial

Every computer gets a free trial of 14 days with all features, without payment details or an account. The trial is counted once per computer: reinstalling the App does not start it again. When the trial ends without a licence, the App switches to view-only mode: your data can still be viewed, backed up, exported and moved to your phone, but it cannot be changed until you buy a licence.

4. Computers

  • One purchase can be active on up to 2 computers at the same time.
  • A computer is identified by an anonymised id derived from the id of its operating system installation. Reinstalling the operating system counts as a new computer.
  • To move the licence to another computer, deactivate it on the old one in the App, or restore the purchase on the new one with the email and the order number from your Paddle receipt.
  • If both places are taken, you can deactivate the previous computers yourself from the new one, no more than once every 30 days. If you need to do it more often, write to us.

5. Activation and Checks

An internet connection is needed to buy, activate and restore a licence. After that the App works offline. When it is online, the App checks the licence with our server about once every 30 days, and a yearly licence also around its renewal date. If our server cannot be reached, the App keeps working until the paid period of the licence ends.

6. Yearly Subscription

A yearly subscription renews automatically at the end of each paid year at the then-current price, of which you will be informed by Paddle. You can cancel at any time through the link in the email from Paddle or on paddle.net. After cancellation the App keeps working until the end of the paid year; the paid year is not refunded except as described in the Refund Policy.

7. Refunds

Refunds are described in the Refund Policy. When a payment is refunded or charged back, the licence it paid for ends on every computer.

8. Updates

We publish updates to the App from time to time. Updates are available to holders of an active licence at no extra charge. We do not promise any particular future feature, and we may change or remove features, provided that the core purpose of the App — keeping meter readings, tariffs and payments — remains.

9. Gift Keys

We may, at our discretion, issue licence keys free of charge. Such a key may be limited in time and may be revoked if it is misused.

10. What You May Not Do

  • share, sell or publish your licence, order number or licence key so that others can use it;
  • circumvent, disable or tamper with the licence check, the trial or view-only mode;
  • resell or sublicense the App.

If you breach these terms, we may revoke the licence.

11. Your Data

Your meter readings, tariffs, bills, payments and photographs stay on your computer and are never sent to us. What the licence check sends to our server is described in the Privacy Policy.

12. Warranty and Liability

The App is provided "as is". We take care that its calculations are correct, but figures produced by the App are for your information: always compare them with the bills of your suppliers. To the extent permitted by law, we are not liable for indirect or consequential damages, and our total liability is limited to the amount you paid for the licence. Nothing in these terms limits the rights you have as a consumer under the mandatory law of your country.

13. Governing Law

These terms are governed by the law of Ukraine, without prejudice to the mandatory consumer protection law of the country where you live.

14. Changes to These Terms

We may update these terms. The version in force is the one published on this page, with its date at the top. Changes do not reduce the rights you received with a purchase already made.
